Welcome to Photo to Dance ("we," "us," or "our"). We use Seedance 2.5 to generate 720p AI videos from photos and other inputs you submit (collectively, the "Service").

We respect your privacy and are committed to protecting your personal data in accordance with global data protection standards, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA). This Privacy Policy explains what information we collect, how we process and store it, the safeguards we apply to your portrait photos, and your rights regarding your personal information.

2. Information We Collect

We collect information directly from you, automatically through your use of the platform, and through trusted third-party service providers.

A. Information You Provide to Us

1. Account and Identity Information: When you register or sign in, we collect your name, email address, password hash, or third-party authentication credentials (such as Google OAuth identifiers).
2. Uploaded Photos & Generation Inputs: Tools with server upload features may receive images, text or other inputs you choose to submit. Pressing Generate submits your character photos and actual text/background inputs for video processing.
3. Local Browser Previews: Selecting photos previews them locally. Pressing Generate uploads them for storage, content safety checks and AI video processing. Purchasing a pack alone does not upload photos.
4. Billing and Transaction Records: When purchasing video packs, transactions are processed securely through certified PCI-DSS compliant payment partners, including Waffo, Visa, Mastercard, Apple Pay, and Google Pay. We never store credit card numbers, CVVs, or bank credentials on our servers.
5. Customer Support: When you contact support at support@phototodance.xyz, we collect your message content, email address, and order details to assist you.

B. Information Collected Automatically

1. Technical and Device Information: IP address, browser type and version, operating system, preferred language, and device screen dimensions.
2. Usage and Analytics Data: Pages visited, effect templates viewed, generation task completion statuses, and referral links. Google Analytics 4 helps us measure website usage and referrals. Microsoft Clarity provides heatmaps and masked session replays to help us understand page interactions and improve usability. These integrations are restricted to our production website.
3. Cookies: We use essential cookies for session management, language selection, and fraud prevention. When analytics is enabled, Google Analytics and Microsoft Clarity may also use analytics identifiers and cookies.

3. AI Processing, Visual Content, and Training Policy

We recognize that photographs of faces and individuals carry important privacy considerations. We apply strict controls to visual inputs and AI model pipelines:

• Strict No-Sale Policy: We do not sell, rent, or trade your uploaded photos, generated videos, or personal data to data brokers or advertisers.
• Zero Public Training on Private Photos: We do not use your private uploaded portraits or generated dance videos to train public AI foundation models without your explicit opt-in consent.
• Inference & Processing: Photos and prompts may be sent to configured storage, content safety checks, and Kie.ai for Seedance 2.5 inference to provide the generation you request.
• Content Filtering: We implement automated safety filters to prevent prohibited, non-consensual, sexually explicit (NSFW), or illegal imagery.

4. Consent and Photo Rights

Photo to Dance is designed for creative, consensual entertainment and commercial content creation:

• Ownership & Permission: You must own or hold all necessary rights and adult permissions for any photograph you upload.
• No Non-Consensual Imagery: You must not upload photos of third parties without their explicit consent, or photos of minors under the legal age of majority.
• No Facial Biometric Templates: We process photos solely to animate posture, match lighting, and synthesize choreography frames. We do not construct biometric identification databases or facial recognition profiles.

5. How We Share Information

We share personal information only under limited operational circumstances:

1. Infrastructure & Hosting: Secure hosting and edge routing providers (such as Cloudflare).
2. AI Inference Partners: High-performance compute clusters solely during active rendering tasks.
3. Payment Partners: Waffo and integrated card networks for secure checkout and fraud prevention.
4. Legal Compliance: When required by applicable law, court order, or to protect the safety and legal rights of our users and platform.
5. Analytics Providers: Google processes website analytics through Google Analytics 4, and Microsoft processes interaction analytics through Clarity as described above. Form input masking is enabled for Clarity.

6. Data Retention and Deletion

• Account Data: Maintained as long as your account remains active.
• Generated Videos: Retained in your account studio so you can review and download your creations. You can delete completed videos at any time.
• Uploaded Photos: Temporary generation inputs are purged from active rendering buffers shortly after task completion.
• Right to Erasure: You can request full account and data deletion by contacting support@phototodance.xyz.
