Terms and conditions governing your access to and use of the Photo to Dance AI video effects and motion choreography platform.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Photo to Dance ("we," "us," or "our") governing your access to and use of our website, AI video generation tools, choreography templates, and associated digital services (collectively, the "Service").

By creating an account, purchasing video packs, uploading photographs, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree with any part of these Terms, you must not access or use the Service.

2. Eligibility and Account Registration

  1. Age Requirement: You must be at least eighteen (18) years of age (or the legal age of majority in your jurisdiction) to use the Service.
  2. Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account.
  3. No Automated Abuse: Creating automated, fraudulent, or disposable accounts to abuse promotional credits, server resources, or payment mechanisms is strictly prohibited.

3. Description of AI Video Generation Services

Current availability: Upload character photos, optionally set a background for Skirt Text Reveal, and enter the skirt text to generate an effect video. Purchasing a pack adds 1, 3 or 5 video uses; generation reserves one use and failed or canceled tasks return it. No free signup or login credits are offered.

Photo to Dance uses Seedance 2.5 to generate 720p AI videos from your photos. Current effects include:

  • Solo and Group Dance Scenes: Creating original dance videos from one or more submitted photos.
  • Skirt Text Reveal: Creating an original twirl scene with a requested short text detail.
  • Fantasy and Pet Scenes: Creating stylized, fictional scenes from submitted photos.
  • Studio Scenes: Creating fictional, non-speaking studio visuals; outputs do not verify or report real-world news.

4. Payment Terms & Transparent One-Time Packs

  1. No Recurring Subscriptions: All video packs sold on Photo to Dance (Single, Trio, Party) are one-time purchases. There are no recurring memberships or hidden auto-renewal charges.
  2. Secure Payment Processing: Payments are processed through our authorized payment partner, Waffo, supporting Visa, Mastercard, Apple Pay, and Google Pay. We never store credit card numbers or payment details on our servers.
  3. Price Confirmation: Pricing is clearly displayed in USD and confirmed on the secure checkout screen before any payment is initiated.

5. 7-Day Money-Back Guarantee & Refund Policy

  1. 7-Day Guarantee: If you are not satisfied with the visual outcome, motion fidelity, or audio sync of your first video generation, you are entitled to a 100% full refund within 7 calendar days of purchase.
  2. How to Request a Refund: Contact our customer support team at support@phototodance.xyz with your order number and email address used at checkout. Approved refunds are credited back to your original payment method within 1–5 business days.
  3. Detailed Guidelines: Full eligibility criteria and processing rules are detailed in our dedicated Refund Policy.

6. Photo Uploads, Consent, and Warranties

  1. Consent and Adult Representation: By uploading any photograph to the Service, you represent and warrant that:
    • You own the copyright to the image, or you have obtained explicit, verifiable permission from the individual pictured.
    • Any person depicted in the photograph must be an adult aged 18 or older. Uploading photos of minors is strictly prohibited.
  2. Prohibited Uploads: You must not upload photos that infringe on third-party copyrights, depict illegal acts, contain sexually explicit (NSFW) material, or are intended to harass, defame, or non-consensually impersonate any person.
  3. Local Browser Preview: Selecting photos previews them locally. Pressing Generate uploads them for storage, content safety checks and AI video processing. Purchasing a pack alone does not upload photos.

7. Acceptable Use, Content Safety, and Reporting

You may use the Service only with inputs, prompts, and outputs that you have the right to use. You must not upload, request, create, share, or use the Service to generate, distribute, or promote content that:

  1. Sexual or NSFW content: depicts explicit sexual activity, pornography, or sexualizes nudity.
  2. Non-consensual intimate imagery (NCII): depicts a real person nude, in sexual activity, or in another intimate situation without that person's explicit consent to the depiction or its sharing. This includes real, manipulated, or AI-generated images and videos, sexual deepfakes, "nudify" or clothing-removal requests, and threats to share such material. Permission to use an ordinary photo does not authorize creating or sharing intimate depictions of that person.
  3. Violent or graphic content: depicts graphic injury, gore, torture, real-world violent abuse, or credible threats of violence.
  4. Hate speech: promotes violence, dehumanization, or abuse against a person or group based on protected characteristics.
  5. Child-unsafe content: depicts, sexualizes, exploits, or endangers anyone under 18, including child sexual abuse material (CSAM), grooming, or sexual exploitation. Photos of minors may not be uploaded.
  6. Non-consensual deepfakes or impersonation: uses a real person's likeness to mislead, harass, or impersonate them without their consent.
  7. Copyright or trademark infringement: uses another party's copyrighted work, trademark, or other protected material without the necessary rights or permission.

These rules apply to uploaded photos, prompts, generated videos, and other material submitted to or created with the Service. We may screen submitted photos and prompts with automated safety tools before generation. Automated checks may make mistakes and cannot guarantee that every prohibited item will be detected.

Reporting and review

Anyone may report suspected prohibited content by emailing support@phototodance.xyz. No account or payment is required. Include a content link, generation task ID, or other information that lets us locate the material, a brief explanation, and an email address for our reply. Please do not attach intimate images or suspected CSAM; describe where the material appears instead.

For an NCII removal request, the depicted person or their authorized representative should also provide a full name as an electronic signature, contact information, and a good-faith statement that the material depicts them or the person they represent, was created or shared without consent, and that the information in the request is accurate. We will ask for any missing information needed to act on the request.

We apply the following response and resolution deadlines:

  1. Acknowledgment within 24 hours: We will confirm receipt by email, provide a report reference, and request any information needed to locate the content within 24 hours of receiving a report.
  2. Urgent safety reports and NCII removal: Reports involving NCII, CSAM, or credible threats to personal safety receive priority review. We will promptly restrict access to identifiable content when a report presents a credible safety concern while the review is pending. For a valid NCII removal request, we will remove the reported material as soon as possible and no later than 48 hours after receiving the valid request. Within that period, we will also make reasonable efforts to identify and remove known identical copies on the Service. Further account investigation or complex-case review does not extend this removal deadline.
  3. Ordinary reports within 72 hours: Within 72 hours of receipt, we will review the report, communicate our decision by email, and carry out the applicable content or account enforcement action if a violation is found.
  4. Complex cases within 7 calendar days: If an ordinary report needs additional evidence or investigation, we will explain the delay and any interim safeguards by email within the initial 72 hours, then provide a final decision and complete any required action within 7 calendar days of the original report. We will send a progress update at least every 72 hours until it is resolved. This extension does not apply to the 48-hour NCII removal deadline.
  5. Outcome and follow-up: Our reply will explain whether content was removed or restricted and the reason for the decision, subject to privacy and legal limits. You may reply to the same email with the report reference and additional information to request reconsideration; we will acknowledge that request within 24 hours and apply the same review deadlines. A shorter deadline required by applicable law takes precedence.

All periods above use elapsed hours and calendar days, including weekends and holidays, and begin when the report reaches our support inbox (or, for the specific NCII removal deadline, when a valid removal request reaches it).

Enforcement

If we reasonably determine that you have violated these Terms, we may reject or stop a generation, remove or disable access to offending content, issue a warning, restrict Service features, suspend your account, or terminate your account. For serious or repeated violations, fraud, or where required by law, we may cancel remaining unused video uses to the extent permitted by applicable law. Any refund eligibility remains subject to our Refund Policy and applicable law. When reasonably practicable, we will notify you through the email address on your account and explain the action; we may act without prior notice when needed to protect users or the Service or to comply with law.

8. Video Delivery and Usage Rights

  1. Video Delivery: Generated videos are delivered as 720p MP4 files. Framing follows the selected effect. AI-generated movement, faces and lettering may vary; review your result before publishing.
  2. Usage Rights: You may use your generated videos subject to the rights in your inputs, applicable model terms and third-party rights. We do not grant rights to third-party people, music, trademarks or example footage.
  3. Audio: Original music is not included or guaranteed. Add music only where you hold the necessary rights or through a publishing platform's licensed music tools.

9. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. While we strive for realistic motion, high-definition fidelity, and prompt delivery, generative AI outputs depend on probabilistic neural networks. To the maximum extent permitted by applicable law, Photo to Dance disclaims all indirect, incidental, special, or consequential damages.
